A 44-year-old Tunkhannock man faces at least three years in prison for his role in an accident gone bad last year.

The attorney for Joseph Mark Ayers, Paul Ackourey, told President Judge Russell Shurtleff Wednesday that his client was a hard worker, welder, and “would like to get back to work to make some money and take care of any possible restitution.”

According to court documents,

Ayesr had an accident on Oct. 1, 2011, was very badly injured, and went into a farmer’s camper and hid.

The property owner called State Police and a scuffle ensued for which Ackourey said, “He has no recollection of the incident, due to his injuries at the time…he was severely injured, especially in the face and eye, and needed surgeries and spent time in two hospitals.”

“He’s very remorseful,” Ackourey added. “From my experience knowing Joe, this was out of character.”

He asked for lower end of sentence and also a mitigated sentence due to the extent of injuries, concurrent sentences, credit for time served.

For an aggravated assault, Ayers was sentenced to 27-120 months in state prison and then for criminal mischief he was to pay restitution of $7,382.90 and spend 9-24 months in state prison with the sentences to be served consecutively.
